Debby is a partner in our Dispute Resolution practice. Debby's practice is focussed on complex high-value disputes. Debby also has particular expertise in restructuring, work-outs and corporate insolvency, having acted for international clients in a number of high-profile bankruptcy and restructuring cases in Indonesia. Debby was trained with Hiswara, Bunjamin & Tandjung and the London office of its associated firm, Herbert Smith Freehills, in her early years of practice; and as a result, Debby has extensive first-hand experience in representing and handling transnational and complex commercial disputes before the Indonesian courts, as well as in domestic and international arbitrations. Debby does not only advise clients on contentious matters but also provides strategic advice and dispute avoidance tactics, given her distressed market experience. Debby practised as a partner in two other reputable firms with international tie-ups before returning to Hiswara, Bunjamin & Tandjung in August 2017.

Experience

Some of the notable cases on which Debby has acted on include:

Bankruptcy, Suspension of Payment & Restructuring

Represented offshore multinational financial institutions in the Suspension of Debt Payment Obligations under the Indonesian Bankruptcy Law (PKPU) of PT Berlian Laju Tanker Tbk.;

Represented J.P. Morgan Chase Bank National Association in the PKPU of PT Arpeni Pratama Ocean Line Tbk.;

Represented PT Bank ANZ Indonesia in the PKPU of PT Asmin Koalindo Tuhup, being the biggest court driven restructuring in 2016 with an estimated total debt of USD 2 billion;

Represented PT Prima Traktor Indonusa in the PKPU of PT Indo Muro Kencana, an Indonesian mining company that hold the third generation contract of work from Indonesian government;

Represented International Lease Finance Corp. (ILFC) and Sierra Leasing Limited in connection with its Indonesian bankruptcy proceedings involving PT Metro Batavia (Batavia Air);

Represented International Lease Finance Corp. (ILFC) and Castle 2003-IA LLC (Castle) with respect to the unpaid maintenance reserves of four 737 aircrafts that are leased to PT Merpati Nusantara Airlines (Merpati);

Assisted Niko Resources Ltd. on the restructuring and sale of Niko's Indonesia oil and gas operations;

Assisted offshore lender in the restructuring of BIS Industries;

Represented creditors in connection with the restructuring of PT Trans-Pacific Petrochemical Indotama;

Represented Indover Bank BV in a bankruptcy action against a state-owned company in Indonesia;

Advised the majority foreign shareholder of the biggest telecommunication company in Indonesia during the bankruptcy process of such telecommunication company;

Represented a multinational bank in the bankruptcy process of Mandala Airlines.


Commercial Litigation

Represented PT Merrill Lynch Indonesia and Merrill Lynch International Bank (Singapore Branch) on a dispute arising out of the purchase of public listed company’s shares;

Represented J.P. Morgan Chase Bank National Association in Indonesian proceedings in relation to disputes arising from certain derivatives transactions entered into by one of the biggest pharmaceutical companies in Indonesia and an Indonesian public listed company;

Represented Boeing in a dispute concerning a claim for compensation filed by the deceased family;

Represented Rio Tinto Exploration Holdings in the Indonesian Administrative Courts in relation to disputes arising from the termination of its mining concessions by the regional administrative officers;

Represented the underwriters for the initial public offering of PT Media Citra Nusantara Tbk in a civil claim lodged by a public shareholder.

Assisted Morgan Stanley and Credit Suisse on a dispute arising out of the notes of US$550 million and US$500 million issued by Asia Pulp and Paper Company. The dispute covered taxation, capital market, and other security issues.


Arbitration

Represented major European telecommunications company on a BANI arbitration arising from a dispute over payment under an infrastructure contract.

Represented an Indonesian joint venture company in an ICC arbitration proceeding between Indonesian and foreign shareholders’ arbitration dispute of a joint venture company in Singapore.

Represented one of the world’s largest cotton trading companies in connection with its arbitration in ICA with its distributor.

Assisted a local investment company in relation to investors’ dispute related to financing scheme against its Singaporean account manager for oil exploration and exploitation project in Libya.

Represented a foreign bank in a shareholder dispute in an SIAC arbitration in Singapore over an allegation of a breach of joint venture agreement of a consortium in an electrical construction dispute arising out of a state company’s procurement procedure in a domestic arbitration.

Represented an oil company in as dispute with one of its subcontractors in an underlying subsea pipe installation at BANI.

Representing a multinational construction company in a domestic arbitration process with respect to subsea pipe installation dispute and in the satellite recusal right petition matter with respect to the domestic arbitration process.
